Frozen Accounts, Family Disputes and Court Delays: The Real Price of Not Having an LPA
It is not a conversation most families want to have, yet across South Wales, more adult children are discovering the hard way that without a Lasting Power of Attorney in place, they may have no legal right to step in when a parent needs them most.
Many people incorrectly assume that a spouse or adult child can automatically manage finances or make medical decisions if a loved one loses mental capacity.
That is not the case.
If a parent suffers a stroke, develops dementia, experiences a serious accident or faces a sudden mental health crisis, their bank accounts can be frozen overnight. Bills continue to mount. Direct debits may fail. Business interests can stagnate. Access to online accounts, investments, shares or even cryptocurrency can be blocked.
For business owners in particular, the consequences can be severe. Without a registered Property and Financial Affairs LPA, no one has immediate authority to manage company assets or sign critical documents. What has taken decades to build can quickly grind to a halt.
Healthcare decisions present an equally difficult challenge.
Without a Health and Welfare LPA, medical professionals will make decisions based on clinical judgement and best interests. While doctors act with care and professionalism, they may not know your parents’ personal wishes. Family members may also disagree about what should happen, creating tension at an already distressing time.
In the absence of an LPA, loved ones must apply to the Court of Protection for a deputyship order. This process can take months and involves ongoing supervision, financial reporting and added costs.
Urgent decisions may be delayed, and control remains subject to court oversight.
By contrast, arranging a Lasting Power of Attorney while your parent still has full mental capacity is straightforward and far more practical. It allows them to appoint trusted individuals to act on their behalf should the need arise, providing clarity and reassurance for the whole family.
